Salisbury NHS Foundation Trust - Case Study
A 61-year-old woman accepted £40,000 in damages after an unnecessary surgery left her with permanent scarring and psychological injuries.
Doctors at a different hospital had previously removed a benign skin tumour from her left thigh, but they suspected it could be a rare type of skin cancer. The claimant was advised to have further tissue removed. However, a locum plastic surgeon at Salisbury NHS Foundation Trust did not run tests or review pathology results and proceeded with a 3 cm excision.
The surgery, which used a bi-lobed flap closure, resulted in a noticeable 60 cm scar and numbness around the area. Later tests confirmed there was no cancer, making the procedure unnecessary.
While the claimant recovered physically and returned to work, she experienced depression and psychological distress due to the scarring, which improved with counselling over the course of a year. Further psychological difficulties were expected to ease over time without additional treatment.
Compensation settlement
Damages of £40,000 were agreed in an out-of-court settlement. Of this, the sum £34,000 was attributed to pain, suffering and loss of amenity that the claimant had experienced as a result of her injury.
