A 25 year old woman was awarded £6,000 (£6,517.72 RPI adjusted) in an out of court settlement for an unnecessary procedure to repair a fractured humerus.
The woman, who was aged 22 at the time of the injury, sustained a comminuted fracture of the mid-distal humerus in a sporting accident. She was taken to a hospital within the University Hospitals of Morecambe Bay NHS Trust.
At that time the clinician decided that conservative treatment of the fracture was the most suitable approach and the fracture began to heal. However the original clinician left the University Hospitals of Morecambe Bay NHS Foundation Trust's employment and the claimant was treated by another clinician.
The surgeon undertook a technically demanding operation to perform an open reduction and internal fixation of the left distal humerous shaft. The operative notes showed that the bone had already begun to repair, making the operation unnecessary.
The claimant attended hospital one month after surgery, complaining of aching and shooting pains. It was decided that although there had been negligence, as the bone would have united in a satisfactory manner through conservative treatment, the negligence had no effect on the claimant's long-term prognosis.
The claimant was awarded £6,000 (£6,517.71 RPI adjusted) in general damages for pain, suffering and loss of amenity.
