Royal Liverpool and Broadgreen University Hospitals NHS Trust (2011) case study
A 63 year old man was awarded a total of £15,000 (£16,389.94 RPI adjusted) in an out of court settlement after he sustained a grade 2 pressure sore to his buttock.
The man, who was aged 59 at the time of his admission to a hospital within the Royal Liverpool and Broadgreen University Hospitals NHS Trust, suffered from a neurological condition that affected his mental capacity. He was incontinent of faeces, had a catheter in situ and a percutaneous endoscopic gastrostomy (PEG) feeding tube.
Two days after admission he had a grade 2 pressure sore on his buttock. After a further 3 days (5 days after admission) it was noted that he showed clinical signs of pressure damage and it was recorded that he should be nursed on his side.
Two months after he was first admitted to hospital the claimant sustained a breakdown of the skin of the sacrum. He was unable to sit because of the pressure sore.
The sore was treated by the application of an adhesive dressing, to which the claimant was allergic. Another type of dressing was applied by staff and he sustained an allergic reaction to this also. The claimant was allergic to all but one type of dressing, and this was used until the sore healed after about 6 months.
It was likely that the nursing notes had understated the severity of his sore, in which deep tissue damage was likely to have occurred.
Compensation Settlement
Judge Hassell at the Manchester County Court approved an out of court settlement of £15,000 (£16,389.94 RPI adjusted) of which £13,500 (£14,750.94 RPI adjusted) was for general damages for pain, suffering and loss of amenity.
