A 37-year-old woman (39 years at trial) accepted damages of £12,000 (£16,740.9 RPI adjusted) in an out-of-court settlement after receiving a tear to her labia during surgery.
The claimant was admitted to a hospital within the Birmingham Women's NHS Foundation Trust for an operation to remove a cyst at the opening to her vagina. During surgery, the gynaecological registrar decided not to remove the cyst but instead to cut into it and suture the edges, allowing the cyst to drain.
Shortly after the surgery, the claimant started to bleed. She was returned to the operating theatre where a different gynaecologist found that the cyst had been partially removed, causing the haemorrhage. The cyst was removed and the wound closed up, but the claimant sustained a tear to her left labia minora.
A skin tag formed over the tear. This caused the claimant considerable pain and discomfort. She underwent a further operation to repair the labia after which she made a full recovery.
In an out-of-court-settlement, the claimant accepted total damages of £12,000 (£16,740.9 RPI adjusted) for the pain, suffering and loss of amenity caused by her injury.
