Particulars of Claim
'Particulars of claim' is a key document that sets out the details of your personal injury claim against the defendant. It is a formal document that is filed with the court, and it must be served on the defendant.
The Particulars of claim will include information such as:
- The background to your claim and the circumstances that led to your injury
- A detailed description of the injury or injuries sustained
- Any financial losses and expenses you have incurred as a result of your injury
- Any special damages you are claiming, such as loss of earnings or medical expenses
- The remedy or compensation you are seeking from the defendant.
Particulars of Claim must be drafted clearly and accurately, as they will form the basis of your case and the court will use them to help determine the defendant's liability.
