West Hertfordshire Hospitals NHS Trust (2000) - Case Study
A 56-year-old female midwife was awarded damages of £41,640 following a manual handling injury sustained while she was working at a hospital within the West Hertfordshire Hospitals NHS Trust.
The claimant who was 50 when the accident occurred, was a qualified midwife of 28 years' experience. Until 1994, she had worked in the community supervising two or three home births each year. She was then required to work in the delivery suite of the local hospital to ensure that her skills and training were kept up to date.
The claimant had a small disc prolapse in her lower spine which caused recurring back problems. Her employer, the West Hertfordshire Hospitals NHS Trust, was aware of the injury. Nonetheless, the claimant was required to move and lift patients in the delivery suite as part of her duties. This included mothers who had received an epidural anaesthetic and were unable to move their legs.
The heavy manual handling work aggravated the claimant's prolapsed disc. Within one year of transferring to the delivery suite, the claimant had to have surgery on her lower back. She retired due to ill health in November 1996.
Compensation award
Judge Baker QC sitting in the Queen's Bench Division awarded general damages of £5,000 (£7,660.20 RPI adjusted) for the pain, suffering and loss of amenity caused by the injury. An award of £31,612 was made for loss of earnings, making a total compensation award of £41,640 (£63,794.14 RPI adjusted).
