West Hertfordshire Hospitals NHS Trust case study

A 56-year-old female midwife was awarded £41,640 in damages after sustaining a manual handling injury while working at a hospital within the West Hertfordshire Hospitals NHS Trust.

At 50, the claimant, a midwife with 28 years of experience, was required to work in the delivery suite to maintain her skills. Despite having a known small disc prolapse in her lower spine, her employer required her to perform heavy lifting, including moving patients who had received epidural anaesthesia and could not move their legs.

The strain of the manual handling work aggravated her existing back condition, leading to surgery within a year of her transfer. She retired due to ill health in November 1996.

Compensation award

Judge Baker QC sitting in the Queen's Bench Division awarded general damages of £5,000 (£7,660.20 RPI adjusted) for the pain, suffering and loss of amenity caused by the injury. An award of £31,612 was made for loss of earnings, making a total compensation award of £41,640 (£63,794.14 RPI adjusted).
