University Hospitals of Leicester NHS Trust (2002) Case Study
A 45 year old woman was awarded £7,500 in a court award at Northampton County Court after a negligent operation to remove her gall bladder left her with tender and lumpy operation sites and a great fear of future hospitalisation.
The woman, who was aged 40 at the time of her operation, was admitted to a hospital within the University Hospitals of Leicester NHS Trust for a laparoscopic cholecystectomy after being diagnosed as having gallstones. The procedure involved the removal of the gallbladder using minimally invasive surgical techniques. The operation was difficult and the claimant's post-operative progress was poor. For the following 2 days she experienced severe abdominal pain, a leakage of bile and developed peritonitis.
The decision was taken to operate again, initially by laparoscopy, but ultimately by open surgery. On this occasion the bile leak was repaired and the claimant's recovery progress was good - although she sustained the inevitable pain and discomfort associated with open surgery.
For 3 days she was cared for in the high dependency unit (HDU), but was keen to leave hospital and was discharged after a further 2 days. A drainage bag was in situ for the next 7 days and during this period she was attended by a community nurse.
The claimant lost a great deal of weight and strength, leaving her unable to perform many of her domestic tasks, and she was reliant on the assistance of friends and family.
Some 4 months after surgery she finally approached her former levels of strength and mobility, but her operation sites remained tender and lumpy.
Although she had generally made a good recovery, her experience had left her with a great fear of being hospitalised in the future.
Compensation Settlement
Judge Harris QC awarded the claimant a compensation payment of £7,500 (£11,278.13 RPI adjusted) for general damages, for the pain, suffering and loss of amenity that she had sustained over the 4 month period
