A 73-year-old woman accepted damages of £900,000 plus periodical payments in an out-of-court settlement after a delay in treatment left her with life-changing injuries.
The woman who was 68 when the injury occurred, was admitted to The Queen Elizabeth Hospital, King's Lynn NHS Foundation Trust with a spinal abscess which was pressing against her spinal cord.
The abscess was not treated as promptly as it should have been and the claimant became tetraplegic. She lost all movement in both legs and became incontinent. She also lost much of the mobility in her torso and upper body, and was left with 15 percent function in her right arm and 70 percent function in her left arm.
As a result of her injuries, the claimant was no longer able to live independently. She was transferred to a care home where she was able to access 24-hour care.

Compensation settlement
Lump-sum damages of £900,000 (£1,085,833.33 RPI adjusted) were agreed in an out-of-court settlement. Of this, £170,000 (£205,101.85 RPI) was attributed to the pain, suffering and loss of amenity caused by the injury.
The claimant would also receive periodical payments of £176,000 per year to cover the cost of future special damages including personal care and therapy. These payments would be index-linked to the Annual Survey of Hours and Earnings.
