Southend University Hospital NHS Foundation Trust Case Study

A 72 year old man was awarded a £100,000 (£144,858.25 RPI adjusted) in an out of court settlement for a hospital acquired infection that led to the amputation of his leg.

The man, who was 69 at the time of his initial operation, underwent surgical removal of cancerous tissue from the bowel at a hospital within the Southend University Hospital NHS Foundation Trust. Although the operation was successful the claimant developed pressure sores on his heels and sacrum. These went undiagnosed and untreated by nursing staff at the hospital and became infected with MRSA.

However the claimant was discharged from hospital.

Three months later he had to be readmitted. The pressure sore on his left heel had improved, but the one on his right heel was incurable, meaning his right leg had to be amputated below the knee.

He remained in hospital for 7 weeks and was fitted with a right leg prosthesis.

The claimant was dependent on his wife and family for physical and emotional support; with his wife having to assist him to wash, dress, and prepare food.

As a result of the loss of his lower leg, the claimant also became depressed and lost his confidence. As a consequence he had to leave his employment.

Compensation Settlement

The claimant was awarded a total of £100,000 (£144,858.25 RPI adjusted) of which £50,000 were general damages for pain, suffering and loss of amenity (estimated by the claimant's solicitor)
