South Tees Hospitals NHS Foundation Trust (2010) - Case Study

A 39-year-old woman accepted damages of £7,500 in an out-of-court settlement following injuries sustained during childbirth.

The woman who was 31 at the time of her injury, gave birth in a hospital within the South Tees Hospitals NHS Foundation Trust. After the baby was born, the attending registrar pulled on the umbilical cord. The cord snapped causing the placenta to deliver in pieces.

The claimant went home but suffered flu-like symptoms for about a week after her discharge. Four weeks later, she passed a large blood clot and returned to the hospital for tests.

An ultrasound scan showed the presence of pregnancy tissue in the claimant's womb. The tissue was removed using a minor surgical procedure known as an Evacuation of Retained Products of Conception, or ERPC.

As a result of the ERPC, the claimant developed Asherman's syndrome, a condition characterised by scarring on the uterus. Her periods stopped and her chances of having another baby were severely compromised. Five years later, the claimant's menstrual cycle returned to normal, and she was able to conceive naturally.

Compensation settlement

Damages of £7,500 (£8,557.36 RPI adjusted) were agreed in an out-of-court settlement for the pain, suffering and loss of amenity caused by the injury.
