Hamilton V Royal United Hospital Bath NHS Trust

A 44-year-old woman settled for over £126,000 after experiencing traumatic awareness during surgery at the Royal United Hospital Bath in 2009.

The claimant was admitted for an emergency laparotomy after suffering abdominal pain. Before the operation, she recalls a discussion between doctors about the required anaesthetic dose. Although the surgery proceeded, she remained conscious but unable to move, feeling severe pain and the incisions for the next half hour until a nurse noticed her twitching and increased the anaesthetic. It was believed her weight may have been under-assessed, leading to insufficient anaesthesia.

Following the operation, a clinical psychologist diagnosed her with moderate trauma stress. The claimant developed severe nightmares, leading to sleep avoidance, and later suffered from post-traumatic stress disorder (PTSD). She became introverted, easily intimidated, and needed a care assistant to leave her home. Psychotherapy was required for up to five years, and she was unable to return to work, with her PTSD symptoms continuing indefinitely.
