Hamilton V Royal United Hospital Bath NHS Trust (2009)

A 44 year old woman (47 years at trial) reached an out of court settlement of over £126,000 following injuries sustained during an operation at the Royal United Hospital Bath.

In 2009 the claimant was admitted to the Royal United Hospital Bath for an emergency laparotomy following abdominal pain.

The claimant recalls a pre-op debate between doctors about the dose of anaesthetic that would be required. The claimant recalls the surgeon confirming that the operation was ready to proceed.

The claimant was unable to move or in anyway signal that she was conscious. She felt severe pain and could feel scalpel incisions as well as the surgeon's hand inside her.

The claimant remained aware for the next half an hour until a nurse noticed that the claimant was twitching and the anaesthetic was increased. The claimant's weight may have been under-assessed affecting the anaesthetic dose.

After the operation the claimant was assessed as being in a moderate trauma stress state by a clinical psychologist.

Thereafter the claimant suffered severe nightmares to the extent where she avoided sleep.

She later developed post-traumatic stress, becoming introverted and easily intimidated by other people. She need a care assistant to assist her when leaving the home. She also need psychotherapy for up to 5 years.

She was unable to work and her symptoms of PTSD continued indefinitely.

Compensation Settlement

The Royal United Hospital Bath made an out of court settlement of £105,000 (£126,329.64 RPI adjusted)
