Queen Mary's Sidcup NHS Trust (2002) - Case Study
A 59 year-old man (60 at trial) accepted damages of £25,000 (£36,683.56 RPI adjusted) following a full-thickness pressure ulcer injury sustained after receiving an epidural anaesthetic at a hospital in the Queen Mary's Sidcup NHS Trust.
The claimant underwent knee replacement surgery in 2001. The operation was performed using an epidural anaesthetic administered via a catheter to the spine. The procedure was deemed successful and, after surgery, the claimant was returned to the ward for post-operative rehabilitation and care.
Three days after the operation, the claimant's wife noticed that her husband's sacrum was black. Six days after the procedure, the anaesthetic wound was found to be leaking and giving off an offensive odour.
A tissue viability nurse was assigned to treat the wound. It was discovered that the claimant had sustained a full-thickness pressure ulcer to his sacrum, causing considerable pain. After a prolonged inpatient stay, the claimant was eventually discharged from hospital.
The wound then became colonised with the Meticillin-Resistant Staphylococcus Aureus bacterium, commonly known as MRSA. The claimant was housebound for three months following his discharge from hospital and was unable to return to work for 10 months after the operation. He was unable to go on a planned holiday and his social life suffered as a result of the infection.
The wound healed poorly. The claimant had to undergo remedial plastic surgery to remove a skin flap which had developed between his buttocks. He made a substantial recovery following the remedial skin flap realignment surgery.

Queen Mary's Sidcup NHS Trust admitted liability and agreed to an out-of-court settlement of £25,000 (£36,683.56 RPI adjusted).
The settlement was made up of £17,000 (£24,944.82 RPI adjusted) for pain, suffering and loss of amenity and the balance for loss of earnings and other expenses.
