An 8 year old child was awarded more than £3 million in an out of court settlement, approved by a Queen's Bench Division Court, after he sustained profound hypoxic ischaemic injury.
The injury occurred due to asphyxiation at birth at a hospital within the Pennine Acute Hospitals NHS Trust.
During the claimant's birth, a lack of oxygen and blood from the placenta caused him to sustain asphyxiation. This resulted in brain injury and damage to the claimant's other organs.
The claimant's life expectancy was impacted by his injuries and was assessed as being between 40 and 42 years. An independent medical report stated that there was not expected to be any improvement in the claimant's condition.
Judge Walker determined an out of court settlement of £225,000 for general damages, and £3 million for special damages. The special damages calculation recognised the need for ongoing care and treatment.
