An eight-year-old child was awarded over £3 million in an out-of-court settlement, approved by the Queen's Bench Division, after suffering a profound hypoxic ischaemic injury at birth.
The injury occurred due to a lack of oxygen and blood flow from the placenta during birth at a hospital within the Pennine Acute Hospitals NHS Trust, leading to brain damage and other organ injuries.
The child’s life expectancy was reduced to between 40 and 42 years, with no expected improvement in his condition, according to an independent medical report.
Compensation settlement
Judge Walker determined an out of court settlement of £225,000 for general damages, and £3 million for special damages. The special damages calculation recognised the need for ongoing care and treatment.
