Lancashire Teaching Hospitals NHS Foundation Trust (2009) - Case Study
The family of a 14-year-old boy was awarded damages of £15,000 after their son died following serious failings at a hospital in the Lancashire Teaching Hospitals NHS Foundation Trust.
The patient had a history of bowel problems and was referred to the Royal Preston Hospital for treatment. In November 2005 his condition started to improve, and he was discharged from hospital care in May 2006.
Five months later, the patient's condition deteriorated. The GP referred him to hospital where he was initially treated with high doses of laxative. On November 1, 2006, a decision was made to disimpact the bowel surgically. However, in the early hours of November 2, the boy suffered a catastrophic perforation of the bowel, leakage and sepsis. He was immediately taken for emergency surgery but died on the operating table.
A post-mortem examination confirmed the cause of death as toxic shock brought on by a perforated bowel.
Expert medical evidence from a Consultant Paediatrician and a Consultant Surgeon confirmed that the standard of medical care fell below an acceptable standard. According to the experts, medical staff failed to give sufficient weight to the boy's medical history and failed to perform a rectal examination or abdominal X-ray before commencing the laxative regime. Had surgery been performed upon admission to hospital, the boy would, on the balance of probabilities, have avoided perforation and survived.
Total damages of £15,000 were agreed in an out-of-court settlement.
