Ipswich Hospital NHS Trust (2013) Case Study

An 11-year-old boy was awarded £462,000 in an out-of-court settlement after a midwife at Ipswich Hospital applied excessive force during his birth, causing permanent disability.

In 2002, the midwife’s use of excessive traction on the boy’s head resulted in Erb’s palsy (Brachial Plexus Paralysis), causing neurological damage to his right shoulder and arm. As a result, his right arm had significantly reduced function, grip, and power, and was much smaller than his left.

The boy required assistance with everyday tasks like dressing and personal care, and his limited arm function severely impacted his daily life. He also suffered psychologically, facing bullying at school that affected his self-esteem.

The prognosis was poor, with the injury's limitations expected to be lifelong, leaving him severely disadvantaged in manual jobs. However, he would still be able to work in some capacity. In adulthood, he would require modest assistance with daily living, especially for domestic tasks, though no future surgery was needed.

Compensation Settlement

Judge Swift determined an out of court settlement of £80,000 (£83,492.19 RPI adjusted) for general damages and a further £382,000 (£398,675.21 RPI adjusted) for special damages.
