Ipswich Hospital NHS Trust (2013) Case Study

An 11 year old boy was awarded £462,000 in an out of court settlement (QBD approved), after excessive force by a midwife during his birth at Ipswich Hospital caused him to be severely and permanently disabled.

During his birth in 2002, the midwife applied excessive force and traction on the child's head, which caused Erb's palsy (also known as Brachial Plexus Paralysis). The child sustained neurological injury to his right shoulder and arm.

As a consequence his right arm was very limited in function and much smaller than his left. Power, function and grip were all markedly reduced on a permanent basis.

Everyday function was severely compromised with the child requiring personal assistance with dressing and personal care. He was also unable to use his arm and hand for everyday activities.

All aspects of his lifestyle were affected, particularly psychologically. He suffered severe bullying at school, which led to a lowering of his self-esteem.

The long term prognosis was poor as it was expected that the limitations caused by the injury were permanent. This would make him severely disadvantaged in manual occupations, although he would be able to work in some capacity in the future.

In adult life some activities of daily living would be compromised and there would be a modest future care requirement, particularly in relation to domestic activities. No future surgery would be required.

Compensation Settlement

Judge Swift determined an out of court settlement of £80,000 (£83,492.19 RPI adjusted) for general damages and a further £382,000 (£398,675.21 RPI adjusted) for special damages.
