Heart of England NHS Foundation Trust Compensation Claim (Case Study)
A 74 year old man (aged 70 at the time of injury) reached an out of court settlement of £20,000 following injuries sustained while in the care of the Heart of England Hospital.
In 2004 the claimant suffered multiple pressure sores during his stay at the Heart of England Hospital. The onset of pressure sores was noted on the fourth day of the claimant's admission, when two small red areas were noticed on his sacrum. On day nine a broken area was recorded on the inside of his right heel, as well as a red left heel and a sore sacrum.
Approximately three weeks after his admission the claimant had broken skin on both buttocks, which were sloughy and offensive smelling. His temperature spiked and he was commenced on intravenous antibiotics.
Four weeks after being admitted to the Heart of England Hospital the skin on the claimant's buttocks had completely broken down but was not offensive, while the wound to his right heel was deep and offensive smelling, and his sacral sore was a large, dry, blackened area.
Six weeks after admission the claimant's sacral sore was assessed as grade three or four, approximately 6cm by 6cm in size with grey-black eschar. The claimant was discharged but had to be readmitted to hospital a week later for the pressure sores to be treated. He remained in hospital for a further three and a half months.
The claimant sustained a grade four or five sacrum sore, grade three left and right heel sores, and a grade three inner ankle sore. He stayed at the Heart of England Hospital for 52 days followed by a further period of 104 days at another hospital.
The bed sores caused the claimant significant discomfort and required daily dressing and cleaning by medical staff. The sores healed about a year after they first developed.
The Heart of England Hospital made an out of court settlement of £20,000 (£24,129.63 RPI adjusted), with approximately £18,000 (£21,716.67 RPI adjusted) in general damages for pain, suffering and loss of amenity.
