Heart of England NHS Foundation Trust Compensation Claim (Case Study)

A 74-year-old man received £20,000 in an out-of-court settlement after developing severe pressure sores during his stay at the Heart of England Hospital.

The claimant, aged 70 at the time of injury, began to show signs of pressure sores four days after being admitted in 2004. By day nine, he had developed sores on his heels and sacrum. Despite treatment, his condition worsened, and three weeks later, the skin on both buttocks had broken down and his sacral sore had become a large, dry, blackened area.

Six weeks after admission, his sacral sore was assessed as a grade three or four wound, approximately 6cm by 6cm, with additional sores on his heels and ankle. He was discharged but readmitted a week later for further treatment, remaining in the hospital for an additional 3.5 months.

The pressure sores caused significant discomfort and required daily care. They fully healed around a year after they first appeared.

Compensation Settlement

The Heart of England Hospital made an out of court settlement of £20,000 (£24,129.63 RPI adjusted), with approximately £18,000 (£21,716.67 RPI adjusted) in general damages for pain, suffering and loss of amenity.
