Great Western Hospitals NHS Foundation Trust (2014) - Case Study
The family of an 11-year-old girl (13 years at trial) secured a settlement award of £10,000 (£10,316.71 RPI adjusted) on behalf of their daughter after she sustained severe burns to her right nostril following surgical error at a hospital within the Great Western NHS Foundation Trust.
The claimant, a school girl aged 11 years at the date of the incident, was admitted to hospital for elective surgery to rectify an ongoing nasal obstruction. Surgeons performed a bilateral tonsillectomy and adenoidectomy (removal of the tonsils and adenoids) and sub-mucosal diathermy to inferior turbinates, a procedure that increases the surface area of the nasal cavity.
During the surgery, the surgeon used an implement known as a finger switch monopolar diathermy with a disposable needle stick to cauterise blood vessels. At the end of the procedure, the diathermy needle was withdrawn from the claimant's nostril while still engaged.
The claimant suffered a severe burn injury to both nostrils. Injuries included a full thickness burn to the midpoint of the alar rim surrounding the right nostril aperture, and a partial thickness burn injury to left nostril. The injuries created U-shaped burn scarring approximately 5 to 6mm in height and 7 to 8mm in width.
Immediately after the operation, the claimant was transferred to a burns unit within the Great Western Hospitals NHS Foundation Trust. She was initially treated with topical creams. Four months later, the claimant was given soft tissue reconstructive surgery under general anaesthetic to repair the deformity in the right nostril.
The injury and subsequent reconstructive surgery left the claimant with a permanent scar to her right nostril measuring approximately 1mm across. The scar was virtually indistinguishable from a conversational distance. Other than a short period of self-consciousness while awaiting reconstructive surgery, the claimant did not suffer any adverse psychological reaction to her injury.
No further treatment was necessary and it was unlikely that the claimant would require additional surgery in the future.

Swindon County Court approved a single settlement award of £10,000 (£10,316.71 RPI adjusted). Of this, £9,159 (£9,449.07 RPI adjusted) was attributable to pain, suffering and loss of amenity.
