A 31 year old man was awarded almost £940,000 in an out of court settlement after steroid medication, administered when he had a campylobacter infection, caused him to develop osteoarthritis in both hips.

The man, who was 24 at the time of his injury, was admitted to Chelsea and Westminster Hospital with chronic abdominal symptoms. The hospital diagnosed that he had ulcerative colitis and gave him steroid medication.

A few days later he was diagnosed with a campylobacter infection, but the hospital continued to treat his illness with steroids for a month.

Steroid medication is contra-indicated for patients with a campylobacter infection, as in those circumstances the medication can cause arthritis.

Six months after his admission to Chelsea and Westminster Hospital the claimant had developed osteoarthritis in both hips. He underwent 9 operations to treat his illness; including multiple hip replacements, hip joint removal and resurfacing and re-fixing of the hips.

He was unable to work in his occupation as a messenger, although he would be able to work in the future if he was able to sit down and stand up on a regular basis. He could no longer take part in his hobbies of football and sports, and suffered from depression.

It was believed that he would need at least 2 further hip replacements on each hip, plus a girdlestone procedure, in which part of the head of the thigh bone is removed to allow it to fuse with the socket of the hip in the straight leg position. This would leave the claimant with a floppy hip.

Compensation Settlement

The claimant was awarded £939,824.83, which included £70,000 (£93,982.48 RPI adjusted) for pain, loss and suffering, and £100,000 for future loss of earnings caused by the injury. (Smith v Manchester).
