Brighton and Sussex University Hospitals NHS Trust (2005) case study
A 57-year-old man accepted £60,000 in an out-of-court settlement after doctors failed to diagnose cauda equina syndrome, a serious spinal condition.
At 54, the claimant visited a hospital within the Brighton and Sussex University Hospitals NHS Trust with back pain. He was sent home with painkillers and advised to rest. Days later, he saw his GP with worsening pain, restricted movement, and difficulty urinating.
A consultant neurosurgeon diagnosed a central disc prolapse and cauda equina syndrome, which requires treatment within 48 hours to avoid permanent disability. Although he underwent surgery, the delay caused lasting damage, leading to incontinence, loss of sexual function, and difficulty with balance and movement.
Despite physiotherapy and treatment, the damage was permanent, as confirmed by an independent specialist.
Compensation settlement
Compensation totalling £60,000 (£81,352.76 RPI adjusted) was agreed in an out-of-court settlement. Damages of £30,000 (£40,676.38 RPI) were attributed to pain, suffering and loss of amenity.
