Bedford Hospital NHS Trust case study

A female, aged 33 at the date of the trial, was awarded a court settlement of almost £348,000 following a work-related illness claim. The claimant's injuries were sustained by lifting and handling heavy patients while working as a nurse at Bedford Hospital.

The claimant first consulted her GP regarding pain in her cervical spine at the age of 27. She complained of a lower back pain injury again in April 1994, when she was referred for investigations and a specialist opinion.

The symptoms were resolved with physiotherapy and the claimant was able to work normally for two years, when she began to experience neck pain again.

Diagnosis

The claimant had an MRI scan which disclosed a posterior prolapse at C5/6 and changes at C6/7 of the low-cervical spine.

After being treated with further physiotherapy, the claimant was transferred to lighter duties. Symptoms recurred once more when the claimant had traction. The traction did not alleviate the symptoms.

The claimant was referred for a neurological opinion and had surgical decompression and fusion at C5/6. In the aftermath of surgery, she again developed lower back pain.

The claimant returned to work, but pain in her neck and lower back recurred immediately, meaning she had to stop working again. She was medically retired just over a year later.

Establishing the NHS Trust's liability for the injury

At the date of the trial, the claimant had very restricted movement in her cervical spine. Her neck was intermittently painful and further deterioration was considered likely. She was also suffering from constant lower back pain and had a scar to the front of her neck.

Her injuries interfered with a lot of daily activities such as sitting for prolonged periods or driving a car. As she had to retire from nursing, the claimant was retraining to become a counsellor.

Bedfordshire Hospital NHS Trust admitted liability for the injury, which was found to be permanent, with further deterioration likely.

Compensation settlement

The Court ordered Bedfordshire Hospital NHS Trust to pay a total sum of £347,923.59.

Total Damages of £167,521 were awarded, with £17,500 for pain, suffering and loss of amenities; £5,000 for loss of congenial employment; Special Damages for loss of earnings at £61,446, and loss of pension at £20,000.
