Airedale NHS Foundation Trust (1998) Case Study

A 44 year old man was awarded a total of £611,050 after a hospital's negligence left him with severe brain damage and permanent physical disabilities, which required constant nursing care.

A hearing at the Queen's Bench Division learned that the man, who was aged 40 at the time of his injury, had cerebral palsy and had been severely mentally handicapped from birth. He had no significant physical disability and his elderly parents were able to care for and supervise him at their home, where he enjoyed a reasonable quality of life.

The claimant also had epilepsy, but this was generally well-controlled. However in 1993 he was admitted to Airedale Hospital with uncontrolled epileptic episode where they failed to administer the required anti-convulsant medication for 72 hours.

Due to the hospital's admitted negligence he went into a status epilepticus and sustained severe brain damage. This left him doubly incontinent, unable to walk and requiring feeding through a gastroscopy tube. His already limited communication skills had been lost and he needed constant nursing care.

Life expectancy was assessed at a maximum of 15 years.

Compensation Settlement

Judge Lynch awarded £80,000 (£150,025.91 RPI adjusted) for general damages for pain, suffering and loss of amenity.

Special damages were as follows:

  • £117,084 for past care (including interest)
  • £348,000 for future nursing care
  • £47,656 for future therapies
  • £16,000 for Court of Protection fees

A multiplier of 10 was used in relation to the awards for future care and therapies.

Total awarded was £611,050 (£1,302,573.66 RPI adjusted)
