Airedale NHS Foundation Trust (1998) Case Study
A 44-year-old man was awarded £611,050 after hospital negligence caused severe brain damage, leaving him with permanent disabilities and requiring constant care.
At the time of his injury, the man, aged 40, had cerebral palsy and had been mentally handicapped since birth, but he had no significant physical disabilities. His elderly parents cared for him at home, where he enjoyed a reasonable quality of life. Though he had epilepsy, it was generally well-controlled.
In 1993, he was admitted to Airedale Hospital during an epileptic episode, but staff failed to give him anti-convulsant medication for 72 hours. Due to this negligence, he suffered severe brain damage, becoming doubly incontinent, unable to walk, and dependent on a feeding tube. His communication abilities were lost, and he required constant nursing care. His life expectancy was estimated at a maximum of 15 years.
Compensation Settlement
Judge Lynch awarded £80,000 (£150,025.91 RPI adjusted) for general damages for pain, suffering and loss of amenity.
Special damages were as follows:
- £117,084 for past care (including interest)
- £348,000 for future nursing care
- £47,656 for future therapies
- £16,000 for Court of Protection fees
A multiplier of 10 was used in relation to the awards for future care and therapies.
Total awarded was £611,050 (£1,302,573.66 RPI adjusted)
