£40k compensation awarded to woman suffering stress from excessive workload
In a recent work related stress claim, compensation was awarded to 59 year old women for injuries suffered 4 years earlier that resulted in a psychiatric breakdown after 39 years of exemplary service and had been awarded an OBE for her services.
The claimant worked for the defendant in a Government role as their Professional Program and Project Delivery Manager.
The Department was understaffed and the claimant was given an unmanageable workload to deal with over a period of a year. The claimant was also bullied and harassed by a member of staff regarding her work.
The claimant was repeatedly undermined and harassed by a co-worker regarding her whereabouts and her work. The co-worker would openly discuss the claimant's work and would spend unnecessary hours going through her completed tasks with the co-worker.
Employer failed to follow correct procedures
Over a period of time, the claimant made a number of complaints to management regarding the co-workers conduct but she was ignored.
Though these complaints were eventually investigated some years later, by such time the damage to the claimant's mental health had already been done and her GP had diagnosed her with Anxiety and Stress due to work. The claimant was prescribed anti-depressants and underwent treatment for her conditions.
The claimant was absent from work for a prolonged period during which time she raised a grievance. The defendant failed to follow a fair and proper procedure and her sickness absence was not managed correctly; both of which resulted in her condition worsening.
The claimant raised a further grievance in regards to the defendant not dealing with her complaints properly.
Eventually, the claimant felt as though her employment had become untenable and she was faced with no option but to leave her employment with the defendant.
Claim settled out of court
With the assistance of Quittance's panel solicitors, the claimant pursued a successful claim for psychiatric injury and financial losses as a result of the issues suffered in the workplace.
The claim was settled out of Court and the defendant paid damages in the sum of £40,000.00 in compensation plus her legal fees.
