A 53-year-old woman accepted damages of £100,000 in an out-of-court settlement after receiving an overdose of antibiotics. The claimant sought to bring her prescription error compensation claim against the Trust following an overdose at a hospital in the Taunton and Somerset NHS Foundation Trust. The antibiotic overdose resulted in the claimant sustaining acute kidney failure.

The claimant was aged 51 at the time of her injury and was admitted to hospital after suffering recurring chest infections. Doctors prescribed intravenous gentamicin, a broad-spectrum antibiotic used chiefly for severe bacterial infections.

The resident antibiotic pharmacist recommended that the gentamicin be stopped, but medics continued with the treatment. The ongoing treatment resulted in an overdose, causing acute kidney injury and hyperkalaemia, a condition caused by abnormally high levels of potassium in the blood.

The claimant went into cardiac arrest. She was transferred to the Intensive Therapy Unit where she gradually recovered kidney function and consciousness.

General damages of £100,000 were agreed in an out-of-court settlement for pain, suffering and loss of amenity.

No award was made for special damages. Prior to the injury, the claimant had been bedridden for 10 years, receiving a high level of personal care. The level of care required after the injury did not increase as the symptoms arising from the overdose were not permanent.
